Employers that do not withhold the required additional Medicare tax on those earning more than $200,000, enacted under the Affordable Care Act, may be subject to penalties in addition to that tax, a senior Internal Revenue Service official said March 12.

If employees pay the 0.9 percent tax at the end of the year, the employer may only be responsible for the penalties, said John Tuzynski, IRS chief of employment tax policy.
